Welcome to Niche Creator®. These Terms of Service ("Terms") govern your use of Niche Creator's website, mobile application, and services (collectively, the "Service"). By using our Service, you agree to these Terms and our Privacy Policy.
By accessing or using our Service, you acknowledge and accept these Terms. We may update these Terms and will provide at least 30 days' prior notice for material changes.
Niche Creator provides AI-driven insights into your creative identity, niche ideas, business and marketing strategies, prospective client profiles, empathy maps, and related educational content.
You agree to provide accurate information during registration and maintain the confidentiality of your account credentials. Access is intended solely for the single user who purchased it.
Our one-time purchase grants lifetime access under reasonable use conditions aligned with the intended educational purpose of the Service. Excessive or automated usage, bot activity, or use beyond personal educational purposes may result in usage caps or termination without refund.
Premium features are initially available under a 6-month free beta period. We reserve the right to impose reasonable usage limits during this phase.
You must use the Service solely for your personal educational advancement. Sharing accounts or reselling the Service commercially is prohibited.
Your user-generated content remains your property. You grant Niche Creator a license to store, use, and analyze your data to provide and improve our Service.
You retain unlimited access to your generated results. If Niche Creator undergoes insolvency or restructuring, we will provide access to download your data and results.
Our Service uses third-party AI providers and integrations. Niche Creator is not responsible for the actions, content, or data practices of third-party services.
You agree to indemnify and hold harmless Niche Creator against any claims, liabilities, damages, or expenses arising from your misuse of the Service or violation of these Terms.
The Service is provided on an "as is" basis without warranties of any kind, either expressed or implied. We do not warrant the Service's accuracy, reliability, availability, or suitability for specific purposes.
These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be subject to the jurisdiction of courts determined by Niche Creator.
Niche Creator is not liable for delays or failure to perform obligations caused by circumstances beyond our reasonable control, such as natural disasters, technical failures, or governmental actions.
We reserve the right to terminate your access immediately, without refund, for violations of these Terms or harmful activities.
Niche Creator is not liable for indirect or consequential damages arising from your use or inability to use the Service.
